    Rarely a day goes by without hearing about an employee who believes that she has unlimited rights to post, tweet, blog and otherwise access social media in connection with work, and the trouble her employer gets into when it attempts to limit that use. Lately it seems that keeping up on recent case law and the National Labor Relations Board weighing in on when disciplining or terminating employees who make derogatory comments, or disclose proprietary and confidential information via LinkedIn or Facebook or Twitter about work is appropriate, is a full-time job. Let's focus and discuss the "bottom-line," items to keep in mind before disciplining or terminating any employee for mixing professional and personal information on social media sites:

     

    • How to create a social media policy.
    • How to educate employees on acceptable social media use in the workplace.
    • What is protected concerted activity and how does it relate to social media?
    • Can social media lead to harassment in the workplace?
    • What are the privacy pitfalls with social media in the workplace?
    • What are the legal constraints for using social media to discipline employees?
    • When and how can social media be safely used in the hiring process?   What are the risks?
    • Protecting trade secrets and proprietary information from disclosure in social media.
    • Preventing harm to the reputation of an employee or employer from social media in the workplace.

     

    Lisa Brown’s primary areas of practice are employment advice, litigation and alternative dispute resolution. Lisa’s practice includes providing advice and training for employers regarding employment policies and procedures, employment agreements, disability discrimination, state and federal family leave laws, hiring, termination, sexual harassment, and federal and state discrimination laws.

     

    Lisa also has extensive federal and state court experience in defending claims of wrongful discharge, breach of contract, Title VII, ADA, ADEA, sexual harassment, employment torts and discrimination. She also defends administrative claims before BOLI, EEOC and other agencies.

     

    She received her B.S. from Northwestern University (Phi Beta Kappa), and her J.D. from George Washington University.  Lisa maintains the highest rating (AV) from Martindale-Hubbell, a peer review rating of a lawyer's legal abilities and professional ethics and is listed in Martindale-Hubbell’s Bar Register of Preeminent Women Lawyers. Lisa serves as an arbitrator for the American Arbitration Association. Lisa is a past member of Multnomah County Arbitration Panel, Counsel of Court Procedures, Oregon State Bar — Multnomah County Local Professional Responsibility Committee (1988-1991) and American Inns of Court XXVII Barrister Group (1987-1991). Lisa is a frequent speaker at both Bullard Law® events and notable events around town.
