    The pandemic’s first wave forced many companies to make employment decisions quickly and amid new and rapidly evolving laws, regulations, and guidance. As the pandemic wears on, companies face new challenges in reopening, resuming work, and making operational decisions, even as these frameworks continue to rapidly change. Among other challenges, depressed economic conditions may necessitate reductions in force, and workers are anxious about their safety and job security. Complicating matters, some workers may be at increased risk for infection, have tested positive for or been exposed to the virus, need to care for someone who has fallen ill, or have to juggle the demands of childcare in the face of school and care provider closures, creating new demands for leave. These challenges have created a perfect storm for government agencies to test new avenues for regulatory enforcement and for plaintiffs’ attorneys to second guess business’ decisions under both well-tested and novel theories of liability.
